Article 1        Identity of the vendor

Het Huis van de Geuze (The House of Gueuze) is a trademark and establishment of Panneels & Partners BV (CBE number 0872.527.668). Het Huis van de Geuze specialises in offering beers, wines and spirits from producers in the Pajottenland and the Senne Valley. Het Huis van de Geuze is located at Nellekenstraat 42A, B-1750 Lennik. Article 2        Applicability and conditions

  1. There is a valid agreement between you and Het Huis van de Geuze to which these general terms and conditions apply, as soon as Het Huis van de Geuze receives confirmation of your order on its website. Het Huis van de Geuze reserves the right to refuse an order or to subject it to additional conditions, such as in the case of large orders, incomplete order procedures or problems with previous orders.
  2. Het Huis van de Geuze only delivers to the following countries: Belgium, the Netherlands, Germany, France, Great Britain, Luxembourg, Bulgaria, Cyprus, Denmark, Estonia, Finland, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Austria, Poland, Portugal, Romania, Slovakia, Slovenia, Spain (except the Canary Islands and Madeira), the Czech Republic and Sweden. For islands such as Sardinia, the Balearic Islands and certain Greek and Swedish islands, a delivery surcharge is charged. If you provide a delivery address in another country, Het Huis van de Geuze may refuse the order.
  3. In order to gain legal access and place an order, one must be at least 18 years old. When registering, the customer must confirm in good faith that the customer is of legal age. If Het Huis van de Geuze subsequently notices that a minor has placed an order, this order will be refused.
  4. The customer remains fully responsible for complying with all tax and excise obligations as well as the legislation of the country where the goods are delivered.
  5. The general terms and conditions are stated on the website of Het Huis van de Geuze. Before an order can be effectively placed, the customer must read and agree to the general terms and conditions. Without acceptance of the general terms and conditions, the customer cannot place an order.
  6. If, in addition to these general terms and conditions, additional special conditions also apply, the above also applies to the special conditions. If the general terms and conditions of Het Huis van de Geuze conflict with these special conditions, the customer can always invoke the text that is most advantageous to him.
  7. For orders that are not placed via the webshop, but via e-mail or telephone, an administrative surcharge of 10 euros (excl. VAT) may be charged.

 

Article 3        Our offer and your order

  1. All products offered by Het Huis van de Geuze are described as completely as possible and in good faith. The offers and prices are valid on the day they are offered on the website.
  2. Products are presented on the website of Het Huis van de Geuze with texts and photos. The description is sufficiently detailed so that the customer can make a good assessment. The photos are usually a true representation of the goods offered but are not binding. If Het Huis van de Geuze has made a mistake, it is not obliged to deliver after all. The years mentioned on the labels in the photos are not vintage years. Het Huis van de Geuze reserves the right to deliver a more recent year. Only the years mentioned in the description of the products in the ‘Vintage’ category correspond to the actual year of the bottles. Het Huis van de Geuze is also not responsible if the producer has changed the printing of the bottles, labels or packaging.
  3. To purchase a product, the customer must add the product to the shopping cart. Afterwards, the customer fills in his contact details, delivery details and billing details. The customer then chooses the method of delivery: home delivery, collection by appointment from Monday to Saturday at Het Huis van de Geuze, collection on Sunday between 10 am and 8 pm at café In de Verzekering tegen de Grote Dorst (Frans Baetensstraat 45, 1750 Lennik), or storage if the customer has a Personal Warehouse Service subscription, see www.huisvandegeuze.be/en/pws/.
  4. In the event of pick-up, the goods must be collected within 3 months. If the goods have not been collected after 3 months, Het Huis van de Geuze reserves the right to resell the goods. In that case, the customer can request a refund of the paid invoice amount minus 10 euros (excl. VAT) administration costs. Any bank and/or transaction costs are charged to the customer in the event of a refund.
  5. In the last step, the customer receives an overview of his order, the customer must accept the general terms and conditions and the customer confirms the payment by pressing the order button with the caption “place order and pay”. Once these steps have been completed, the order is valid.
  6. The order is complete and the agreement between the customer and Het Huis van de Geuze is final as soon as Het Huis van de Geuze confirms the order by e-mail and as soon as Het Huis van de Geuze has received approval for the payment transaction from the issuer of the payment card. If the issuer of the payment card refuses to agree to the payment to Het Huis van de Geuze, Het Huis van de Geuze cannot be held responsible for delays in delivery and/or non-delivery of the order. Orders without valid payment in the name of the registered cardholder will not be accepted or processed. If the customer opts for bank transfer, the order is only final once the amount due is in the bank account of Het Huis van de Geuze.

 

Article 4        Right of withdrawal

  1. Consumers have the right to inform the seller within 14 working days after receipt of the goods that the purchase is being withdrawn. The consumer can return the order, without payment of compensation and without having to give a reason. This rule only applies to private individuals.
  2. After this notification, the consumer must return the goods to Het Huis van de Geuze within 7 days. The return address is Nellekenstraat 42A, 1750 Lennik, Belgium. The customer is responsible for the return shipment. The costs of returning the goods are borne by the consumer. Unstamped or insufficiently stamped shipments will always be refused and returned to the customer.
  3. During the first 14 days after delivery, Het Huis van de Geuze expects the customer to handle the order and the packaging with care. Only unopened bottles, bag-in-boxes and other containers can be returned. Opened goods cannot be returned and will not be refunded.
  4. The goods must be returned via BPost, PostNL, DPD, DHL, Fedex or UPS in the same packaging as they were delivered. The consumer may also return the goods to Het Huis van de Geuze, Nellekenstraat 42A, 1750 Lennik, by prior arrangement.
  5. Het Huis van de Geuze may apply a depreciation to returned items and not refund them in part or in full if the product is incomplete, the packaging has been opened or if the products or packaging have been damaged by the customer.
  6. The full purchase price of the returned goods will be refunded by Huis van de Geuze within 7 days, including any costs paid for home delivery.
  7. Het Huis van de Geuze will only refund the return shipping costs if the customer did not receive the item he ordered.
  8. If the customer wishes to cancel an order and the goods have already been shipped, the customer must wait until the item arrives and then return the item to Het Huis van de Geuze in accordance with the applicable rules for returns.
  9. The refund will be made using the same payment method as the customer used to pay.
  10. Orders by VAT-liable persons are not covered by the Belgian Act on Trade Practices and Consumer Information and Protection of 14 July 1991. Within 30 days, Het Huis van de Geuze will refund the full purchase price of the returned goods minus a return fee charged at 10 percent of the value of the returned goods with a maximum of 50 euros (excl. VAT). The delivery costs will not be refunded.
  11. To correctly exercise his right of withdrawal, the customer must complete the form below and send it by e-mail to webshop@huisvandegeuze.be. If you have any questions when filling out this return form, please contact Het Huis van de Geuze. Het Huis van de Geuze will send an email confirmation of receipt of the withdrawal.

Article 5        Price

  1. The price of each product is always clearly stated. All products offered by Het Huis van de Geuze are described as completely as possible and in good faith. The prices as well as the promotional offers are valid on the day they are offered on our website. All prices include VAT.
  2. Owners of pubs, restaurants, hotels or drinks shops who come to collect orders with a value of at least 500 euros (excl. VAT) themselves can enjoy a discount of 10 percent on the displayed prices, except for the promotional offers. If they wish to take advantage of this offer, they must contact Het Huis van de Geuze via webshop@huisvandegeuze before placing the order.
  3. If the customer is not logged in or has not provided a delivery address, the VAT rate applicable in Belgium will be applied by default. If the customer indicates that they will collect the goods from Het Huis van de Geuze, the VAT rate applicable in Belgium will also be applied. In case of delivery in an EU Member State other than Belgium, the VAT rate applicable in that country will be applied.
  4. In addition to the purchase price of the goods, shipping costs may also be charged. In that case, this will always be stated before the order is finally placed.
  5. Het Huis van de Geuze is responsible for the transfer of the paid VAT to the various EU Member States via the OSS VAT return system.

 

Article 6        Payment

  1. The customer can choose from the following payment methods: Bancontact, iDeal, VISA, Mastercard, American Express, P24 Apple Pay, Google Wallet or via bank transfer. Other payment methods are not accepted.
  2. To ensure a secure online payment and the security of personal data, SSL technology is used. SSL ensures that your transaction data is encrypted and made unreadable when sent via the internet. The customer does not need any special software to pay with SSL.
  3. Unpaid goods remain the property of Het Huis van de Geuze.

 

Article 7        Conformity and warranty

  1. All products offered on www.huisvandegeuze.be are legal in accordance with Belgian legislation as it exists at the time of placing the order. Customers who wish to have the goods delivered in an EU Member State other than Belgium should always consult the laws and regulations in their own country if they doubt the legality of their purchase in their own country. Het Huis van de Geuze can in no case be held liable if the products offered by us are used incorrectly or irresponsibly by the buyer, nor for material or physical damage to third parties caused by incorrect and/or illegal use of the goods offered. The consumer is entitled to the statutory guarantee of two years. However, the guarantee can never be longer than the ‘best before’ date stated on the bottle.
  2. Loss and/or damage to ordered goods during transport by a parcel carrier is the responsibility of Het Huis van de Geuze.
  3. Products which are neglected or prolonged exposure to light or moisture will not be taken back under warranty. If the customer wishes to make a claim under the product warranty, he must contact Het Huis van de Geuze, stating all details of the warranty case.
  4. If damage to one or more goods is found upon delivery, the customer has the right to either replace the damaged product with the same product or replace it with another product of the same type and in the same price range, or to a full refund of the damaged product.

 

Article 8        Delivery and execution

  1. All goods are delivered to the address that the customer has indicated when ordering.
  2. The customer is responsible for correctly and completely providing the delivery address (including house number, box number if applicable, and postcode) as well as an address and telephone number where the customer can be reached or via which he can obtain the necessary information from the carrier regarding the time of delivery.
  3. If the customer has provided an incorrect or incomplete address and the order cannot be delivered, the transport costs for the second delivery will be borne by the customer.
  4. When the goods are in stock, the delivery period in Belgium and the Netherlands is in principle 2 to 3 working days. When a product is not in stock, the delivery period will be 4 to 8 working days. For other EU Member States, the delivery period can take 4 to 10 working days, depending on the destination. The customer will be informed by e-mail when the order leaves the warehouse of Het Huis van de Geuze.
  5. Deliveries are only made on weekdays during office hours. The customer will be informed by the parcel carrier by e-mail or text message regarding the expected time window of delivery.
  6. Collection is possible from Monday to Saturday by appointment at Het Huis van de Geuze (details regarding the collection address and time can be requested via webshop@huisvandegeuze or via text message or whatsapp +32 498 52 23 22) and on Sunday between 10 am and 8 pm at café In de Verzekering tegen de Grote Dorst (Frans Baetensstraat 45, 1750 Eizeringen).
  7. Het Huis van de Geuze uses the services of various parcel carriers for home delivery: DPD, PostNL and Bpost. During the ordering procedure, once the delivery address has been entered, the customer is clearly informed of the precise handling and shipping costs. The shipping costs vary depending on the destination, the weight and size of the order and the applicable VAT rate of the country of destination. A surcharge is charged for packages weighing more than 20 kg.
  8. Home delivery is done in sturdy bottle shipping boxes, which have been certified by DHL, UPS and DPD. Double-walled cardboard dividers protect the bottles from damage. The bottle shipping boxes are suitable for use with parcel carriers where the boxes are guided over a conveyor belt with a drop height of maximum 1 meter and/or when there is no throwing and tossing during transport. The maximum weight per box is 30 kg. A box contains a maximum of 18 750ml bottles or 24 375ml bottles or a combination of these.
  9. If the order contains multiple products, the order will only be sent when all goods are in stock. However, if the order cannot be delivered within 10 working days, Het Huis van de Geuze will inform the customer and a decision will be made in consultation about when the goods will be delivered.
  10. If the customer cannot receive the order, it will be stored for 5 working days at a pick-up point of the parcel carrier. The customer is responsible for collecting the order on time. If the order is not collected on time and is returned to Het Huis van de Geuze by the parcel carrier, Het Huis van de Geuze will inform the customer of this upon return of the order. The customer can request Het Huis van de Geuze to resend the order, subject to payment of the return fee of 15 EUR (incl. VAT) per box charged by the parcel carrier and the shipping costs for resending the order.
  11. With a few exceptions (e.g. freshly filled bag-in-box lambic), Het Huis van de Geuze only offers products that can normally be delivered within 10 working days. If a product cannot be delivered within 20 working days, Het Huis van de Geuze will refund the purchase price.
  12. Shipments are always at the risk of Het Huis van de Geuze. The customer therefore does not have to worry about goods that are lost or damaged during transport by a parcel carrier.
  13. If the consumer returns the goods within 14 days after delivery based on his right of return, the consumer is responsible for the transport. In that case, the consumer must use the return form (see article 4).
  14. The customer must report visible defects within 3 days after delivery using photos of the packaging and/or damaged or non-compliant goods.
  15. Het Huis van de Geuze cannot be held liable for damage resulting from the goods not being in stock or late delivery or non-delivery by the parcel carrier. The liability of Het Huis van de Geuze remains limited to the value of the goods not received.

Article 9        Duration

  1. A valid agreement runs for a maximum of two years.
  2. If Het Huis van de Geuze cannot deliver a product on time, the customer will be contacted before the expiry of the expected delivery period to agree on a new delivery period. If Het Huis van de Geuze also fails to meet this second delivery period, the customer may terminate the agreement free of charge. Het Huis van de Geuze will then refund the purchase price within 3 working days after the termination.

 

Article 10      Force majeure

  1. In the event of force majeure, Het Huis van de Geuze is not obliged to fulfil its contractual obligations. In this case, Het Huis van de Geuze may either suspend its obligations for the duration of the force majeure situation or definitively dissolve the contract. In the event of force majeure, Het Huis van de Geuze shall not be liable to pay any compensation to the customer.
  2. Force majeure is any circumstance beyond the control and will of Het Huis van de Geuze, which prevents the fulfilment of our obligations in whole or in part. This includes strikes, fire, business disruptions, power failures, disruptions in the telecommunications network or connection, disruptions of the communication systems used, the website of Het Huis van de Geuze being offline, non-delivery or late delivery of goods or packaging by suppliers or other third parties, etc.

 

Article 11      Intellectual property

  1. The website and logos of Het Huis van de Geuze, the texts, photos, names and communication in general are protected by intellectual property rights that belong either to Het Huis van de Geuze or to its suppliers or other rights holders.
  2. It is prohibited to use and/or make changes to the intellectual property rights as described in this article. Photos, videos, names, texts, logos, the colour combination, etc. may not be copied or reproduced without the prior and express written consent of Het Huis van de Geuze.

 

Article 12      Complaints and disputes

  1. Het Huis van de Geuze strives for 100% customer satisfaction. If the customer nevertheless has complaints about the services and/or goods of Het Huis van de Geuze, the customer can contact the customer service of Het Huis van de Geuze via webshop@huisvandegeuze.be. Het Huis van de Geuze will handle every complaint within 5 working days.
  2. In the event of disputes, only the Court of First Instance Antwerp, Antwerp division, the Enterprise Court Antwerp, Antwerp division and the Justice of the Peace Brussels – Justice of the Peace Lennik are the competent courts.
  3. All agreements that Het Huis van de Geuze concludes with its customers, regardless of their place of residence, are exclusively governed by Belgian law. If, for reasons of international law, another law applies, the interpretation of these general terms and conditions will first refer to the Belgian Market Practices and Consumer Protection Act as included in the Code of Economic Law.
  4. The customer also has the option to resolve the dispute outside the court and can contact Becom for this. Only complaints submitted via https://becom.digital/nl/consumers-complaints will be processed. This way, Becom immediately has all the correct information to process the complaint and to mediate neutrally between the customer and Het Huis van de Geuze.
  5. The consumer can also contact the Consumer Ombudsman of the FPS Economy. This ombudsman is authorised to receive any request for out-of-court settlement of consumer disputes and will in turn either process the request itself or forward it to a qualified entity. The Consumer Ombudsman can be reached via https://consumerombudsman.be/en.
  6. In the event of disputes of a cross-border nature, the consumer can appeal to the Online Dispute Resolution Platform of the European Union via https://ec.europa.eu/odr.
  7. Only the terms and conditions and the privacy policy in Dutch are legally valid. The French and English translations of the terms and conditions of sale and the privacy policy are for information purposes only and cannot be used in legal proceedings or in mediation proceedings.
